Disputes over security deposits comprise a substantial percentage of landlord/tenant cases in the state of Alabama. Lawsuits typically allege that a given landlord unfairly withheld deposit money for cleaning, repairs or unpaid rent, or, in certain cases, failed to return the deposit at all. Alabama’s landlord/tenant laws state that landlords have 35 days from the end of the tenant’s lease to return her or his deposit. While every tenant would love to have their full deposit returned back to them, there are certain cases in which a landlord may withhold some or all of the deposit:
- Unpaid rent.
- Moving out without providing sufficient notice.
- Unpaid utility bills.
- Repairing damage.
- Extensive cleaning.
- Undoing changes a tenant made to the property.
Keep in mind that can only sue for the amount of the security deposit that your landlord wrongfully withheld. If you’re considering filing a claim regarding your security deposit, it’s prudent to keep copies of your demand letter and any other correspondence between you and your landlord; your signed lease agreement; a document stating Alabama’s state law(s) governing security deposits; receipts and/or cancelled checks regarding your security deposit; move-in and move-out inventories (i.e. photos, videos, checklists, etc.); and any and all witnesses that are (or were) familiar with the condition of your unit prior to your moving out.
The state of Alabama provides tenants with fourteen business days to remedy or cease a rental agreement violation — or simply move — before the landlord can file for eviction. Keep in mind, however, that if the fourteenth day falls on a weekend or an official holiday, the fourteenth day will automatically move to the next business day.
